Abstract
While the articles regulating cases of Bahrain’s international jurisdiction are keen to establish various controls that seek to ensure close ties to the conflict with Bahrain and the appropriateness of its courts to consider it and ensure the greatest possible effectiveness of national judgments abroad, it is clear from some of these cases that they raise problems related to either narrowing the jurisdiction of the international court of Bahraini courts, or on the contrary, to expand it. Hence, the importance of this study is to monitor these problems by conducting a new approach to the articles regulating the cases of Bahraini jurisdiction to propose solutions and recommendations without stopping only at the limits of the legislator’s position. The importance of this topic also shows the absence of any comparative analytical study in the Bahraini jurisprudence of the cases of internationsal jurisdiction of Bahraini courts, which have been organized by the legislator since the issuance of the Civil and Commercial Procedures Law in 1971, that is, five decades ago without being reconsidered or reviewed since that time. The study concluded with several results and recommendations for amending some articles of international jurisdiction to grant jurisdiction to Bahraini courts in some cases, or, on the contrary, not to maintain their jurisdiction in other cases.
