Abstract

This study aims to analyze the most important challenges facing international humanitarian law in light of the current scientific and technological development, which has produced new data represented in the emergence of terrorist organizations that have become a new challenge for the promising international humanitarian law that threatens international security as well as the resort of states to use accurate military technologies in combat operations without observance of the principles of international humanitarian law, which oblige the fighting parties to remove civilians and civilian objects from the accelerator of combat operations. In the study, the researcher relied on two main topics, the first is a study of the nature of international humanitarian law, and the second is a study of the most prominent challenges faced by international humanitarian law. In order to answer the problematic of the study and its questions, the researcher used the analytical descriptive approach due to its suitability for this kind of studies that prepare to analyze the importance of the rules of international humanitarian law and highlight the international challenges facing these rules. The study recommends the necessity of adapting the rules of international humanitarian law to the pattern of the current international system and wasting the efforts of the United Nations to convince the countries of the world to abide by the rules of international humanitarian law, especially the use of internationally prohibited weapons in armed conflicts.
