The Constitutional Regulation of Seat Vacancy of a Palestinian Legislative Council Member

Abstract
Objectives: The study aimed to identify the constitutional and legal regulation of the vacancy of a member of the Legislative Council and to reveal the shortcomings in the legal texts that dealt with regulating membership. Methods: The researchers adopted the descriptive and analytical approach of the legal texts, which are considered one of the most important legal research tools that are most appropriate to the nature of the study, to reach the desired results in a complete and comprehensive manner for the various aspects of the study to achieve its objectives. Results: The study showed that there are many aspects of legislative omission, whether the failure or omission of the legislator to regulate the extraordinary cases and the lack of constitutional and legal texts of relation to regulating the vacancy of membership in the Legislative Council, especially the vacancy of membership in the case of incompatibility. Conclusions: In this study, the researchers concluded several recommendations, the most prominent of which was the need to amend the provisions of the Palestinian Basic Law of 2003 and the two related laws to fill the legislature's shortcomings in regulating the vacancy of membership in the Legislative Council.
