Abstract

Objectives: The study aimed to reveal the issue of the legal structure for compensating a legal person for moral damage by clarifying what a legal person is, clarifying the concept of moral damage and its connection to a legal person and the basis for compensating a legal person for moral damage. Methods: To achieve the objectives of the study, the researcher employed the descriptive-analytical method, which involves examining various theoretical and cognitive concepts that form the basis of the discussed topic. Additionally, the method included analyzing legal texts related to the provisions of compensation for moral damage and their applicability to compensating a legal person for moral damage under the Jordanian Civil Law. Results: This study concludes with the most important findings and recommendations. One of the most prominent findings of the study is that the Jordanian legislator recognized the legal protection of the legal person for moral damage, whether in the general legislative texts, or the special legislative texts that were mentioned within the intellectual property laws, considering intellectual rights as among the moral rights that prove to the legal person. The study also concluded that it is possible to benefit from the generality of the texts mentioned in the civil law, especially Article (267/1) Jordanian civil law and intellectual property laws, in the legislator's emphasis on the right of a legal person to compensate for moral damage. Conclusions: Based on the conclusions of the study, the researcher recommended that the legislator amend the legal texts, the general texts regarding compensation for moral damage, including the legal person explicitly and considering this as a stable legal principle.
